PCMKE LLC: Terms of Service

Welcome to PC MKE. By accessing pcmke.com or purchasing any product or service from us, you agree to the following Terms of Service. Please read them. They're written to be clear and fair, not to bury you in fine print.

These Terms apply to all visitors, customers, and anyone who interacts with our website or services. If you don't agree, please don't use the site.

1. About PC MKE

PC MKE is a Milwaukee-based small business that sells, repairs, and supports affordable gaming PCs. We operate online at pcmke.com and serve customers locally and nationally.

2. Eligibility

You must be at least 18 years old to make a purchase through PC MKE. By placing an order, you represent that you are 18 or older, or are doing so with the consent and supervision of a parent or legal guardian. We reserve the right to refuse service to anyone at our discretion.

3. Products & Pricing

Accuracy

We do our best to keep product descriptions, specs, and pricing accurate. However, errors can happen. If a product is listed at an incorrect price or with incorrect information, we reserve the right to cancel or adjust the order and notify you before fulfillment.

Pricing & Availability

All prices are listed in U.S. dollars. PC MKE reserves the right to change pricing at any time without prior notice. Product availability is subject to change and is not guaranteed until your order is confirmed.

Custom Builds

If you order a custom-configured system, final pricing and specifications will be confirmed with you before the build begins. Changes requested after a build has started may result in additional costs or delays.

4. Orders & Payment

By placing an order, you authorize PC MKE to charge your selected payment method for the total amount due, including applicable taxes and shipping fees.

Orders are not guaranteed until you receive a written confirmation from PC MKE. We reserve the right to cancel any order for any reason, including but not limited to product unavailability, pricing errors, or suspected fraudulent activity. In the event of a cancellation, you will receive a full refund.

Payment is processed through a secure third-party payment provider. PC MKE does not store your payment card information.

5. Shipping & Delivery

PC MKE ships to addresses within the United States. Estimated shipping times are provided at checkout and are not guaranteed. PC MKE is not responsible for delays caused by carriers, weather, or other circumstances outside our control.

Risk of loss and title for products passes to you upon delivery to the carrier. If your order arrives damaged, you must report it to us within 24 hours of delivery. Please see our Return & Refund Policy for details.

6. Returns, Refunds & Warranty

All returns, refunds, and warranty claims are governed by our separate Return & Refund Policy and Limited Warranty Policy, both available on pcmke.com. By purchasing from PC MKE, you agree to those terms as well.

Key points:

All sales are final for a change of mind.
Damaged or dead-on-arrival (DOA) units must be reported within 24 hours of delivery.
Every PC MKE system comes with a 30-Day Product Warranty, a 2-Year Service Warranty, and lifetime 1-on-1 support.

7. Repair Services

PC MKE may offer repair services for customer-owned hardware. By submitting a device for repair, you acknowledge:

PC MKE will not be held responsible for pre-existing damage or data loss.
It is your responsibility to back up all data before submitting a device for service.
Repair quotes are estimates. Final costs may vary based on what is found during diagnosis.
Devices not picked up within 30 days of a completed repair may be subject to a storage fee or treated as abandoned.

8. Trade-In & Used Equipment

PC MKE may accept trade-ins or purchase used equipment at its sole discretion. All offers are final once accepted. PC MKE is not responsible for data remaining on any device sold or traded to us. It is your responsibility to wipe your device before transferring it.

9. Acceptable Use of This Website

When using pcmke.com, you agree not to:

Use the site for any unlawful purpose
Attempt to gain unauthorized access to any part of the site or its backend systems
Scrape, crawl, or harvest data from the site without written permission
Submit false information or impersonate another person
Interfere with the site's operation or security

We reserve the right to block or restrict access to users who violate these terms.

10. Intellectual Property

All content on pcmke.com, including text, images, logos, product names, and design is the property of PC MKE or its licensors and is protected under applicable intellectual property laws. You may not reproduce, copy, or use any content from this site without our prior written permission.

11. Disclaimer of Warranties

PC MKE's products and services are provided "as is." To the fullest extent permitted by law, PC MKE disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except as expressly stated in our Limited Warranty Policy.

PC MKE does not warrant that the website will be error-free, uninterrupted, or free of viruses or other harmful components.

12. Limitation of Liability

To the fullest extent permitted by law, PC MKE's total liability to you for any claim arising out of or related to these Terms or your use of our products or services shall not exceed the amount you paid for the product or service giving rise to the claim.

PC MKE is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, loss of data, or business interruption, even if we have been advised of the possibility of such damages.

13. Indemnification

You agree to defend, indemnify, and hold harmless PC MKE, its owner, and any employees or contractors from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the site, your purchases, or your violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Milwaukee County, Wisconsin, and you consent to personal jurisdiction in those courts.

15. Changes to These Terms

PC MKE reserves the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Your continued use of the site after changes are posted constitutes your acceptance of the updated Terms.
